When the property of debtor is not enough to pay off all the debt , if the debtor is the business corporation , the procedure of bankruptcy will be started ; if the debtor is out of the business corporation , the equal principle will be applied , and the participate in the distribution will be used 在财产不足应清偿全部债务时,若被执行人为企业法人,则启动破产程序;若被执行人为自然人或企业法人以外的组织时,则适用平等原则,启动参与分配程序。目前立法框架下的参与分配制度主要是弥补有限破产主义不足之权宜之计,并不成熟。
Article 87 when there are two or more creditors or debtors to a deal , each of the joint creditors shall be entitled to demand that the debtor fulfil his obligations , in accordance with legal provisions or the agreement between the parties ; each of the joint debtors shall be obliged to perform the entire debt , and the debtor who performs the entire debt shall be entitled to ask the other joint debtors to reimburse him for their shares of the debt 第八十七条债权人或者债务人一方人数为二人以上的，依照法律的规定或者当事人的约定，享有连带权利的每个债权人，都有权要求债务人履行义务；负有连带义务的每个债务人，都负有清偿全部债务的义务，履行了义务的人，有权要求其他负有连带义务的人偿付他应当承担的份额。
