Through studies of the integrated , cross - cutting and particularity in natural environment and social identity , in the light of administrative law to balance the interests of a comprehensive and broad norms , from the advanced nature of environmental resources from the united states jurisprudence , legislation and the eu environment laws and policies , the view of this article is that " to be measured principle " should be extended the context of environmental law as a fundamental principle , namely that social activities in any initial , the main players in the market have a responsibility to take into account the benefits of the environment and natural resources 针对我国房地产企业有能力破坏却没能力保护或不愿保护的尴尬现状,本文在广义的环境法的理论基础上,通过对房地产企业在项目开发中保护环境的实证研究,考察其在市场活动中对环境权益与经济权益的利益衡量问题。文中剖析了房地产企业对环境权益衡量的商业化特性,探求环境法学在面对这一严峻挑战时的出路。本文认为,在广义环境法范畴内,房地产企业对环境权益与经济权益的利益衡量,应引入“应予衡量”的原则特性,指导企业的市场行为。
