  研究内容本研究以最高人民法院关于医疗诉讼中实行举证责任倒置的司法解释出台为背景，分析了该司法解释在实践中的反应与理论上争议：在实践中出现了能否引发诉讼潮、能否阻碍医学的发展等舆论呼声，理论界对于同时适用过错推定原则和因果关系原则持有异议，对于该司法解释未能对正常的医疗伤害以及并发症做出阐述可能存在的隐忧进行了分析，提出了根据医学科学的特殊性应该实行免除责任等学术争议。
