   根据“统一配刑论”的原理，笔者提出了“配刑情节”的概念，并采取归谬法，将“入户抢劫”同时置于定罪、量刑、配刑三种语境下进行比较，得出“入户抢劫”既不应该是犯罪情节，也不可能是量刑情节，作为配刑情节也存在理论障碍的结论，进一步推断出“入户抢劫”不应该作为法定情节，即使作为法定情节也应该是配刑情节的结论，而且在司法和立法中应从严把握“户”的认定标准，正确认识和配置“入户抢劫”的法定刑，防止罪刑失衡，还对具体案件和审判实践中要解决的几个问题提供了参考方案。
