  在此基础上，笔者发现两国法律规定的相似之处：一般的赠与合同（允诺）赠与人可以任意撤销赠与，慈善性捐助合同（允诺）的赠与人则不享有任意撤销权；当情势发生变更，在特定情形下，赋予赠与人拒绝履行赠与义务的权利或者免除合同责任。
